The purchase of products (clinics, lessons, virtual coaching, camps, merchandise, etc) on www.jamesignatowich.com are subject to the following terms and conditions. It is recommended that all customers first review these policies before making any purchase.

 

Each virtual coaching/online lesson sold is licensed to a single user only. Customers are not allowed to distribute, copy, share and/or transfer the product/s they purchased to any third party or person. 

 

All transactions are made through payment gateways like PayPal that use secure SSL encryption. These payment gateways are secure and safe for using all types of credit and debit cards in different countries and your details are not stored during the payment process.

 

All purchases that are made on www.jamesignatowich.com are non-refundable unless otherwise stated. Since the virtual coaching/lessons made available on this site are intangible, we cannot accept any request for refunds. In-person coaching, lessons, camps, and clinics may be refunded due to particular cases where inclement weather occurs and no rain date is possible, or no indoor venue is available to switch the event to. This is event-based, please view the policies in the specific event listing for more details. In the case where a purchase error is made please contact us directly at info@jamesignatowich.com to discuss a resolution.

By placing an order on www.jamesignatowich.com you indicate that you are at least 18 years old (or have a parent or guardian’s permission to make a purchase on this site), and accept these terms and conditions, which will apply to all orders that are placed. None of these terms and conditions affect your statutory rights.

Your card information is not stored, and all card information is handled by Wix Payments or PayPal. RETURN POLICY

 

As stated above, purchases that are made on www.jamesignatowich.com are non-refundable unless otherwise stated. Since the virtual coaching/lessons made available on this site are intangible, we cannot accept any request for refunds. As they are deemed “used” after the customer has downloaded or opened the online coaching documents or recordings sent to them. This means we have a strict no-refund policy in regards to dissatisfaction with the virtual coaching/lessons we have available. ONLINE VIRTUAL LESSONS, COACHING, TRAINING, CLINICS | CLIENT AGREEMENT

 

In consideration of my being able to participate in the virtual lessons/coaching on www.jamesignatowich.com, I understand that I must purchase a package that consists of pickleball specific training guides and must read and agree to where I assume the risks for participation, waive of liability, and virtual lessons/coaching policies and procedures.

 

I understand that the virtual coaching/lessons program is voluntary and that James Ignatowich Pickleball and his team will develop and guide me through the lessons tailored specific to me and my needs as a pickleball player. I understand that the lessons/coaching guides are designed for those individuals who do not have certain medical limitations regarding diet and exercise.

 

If applicable, I will accurately and completely disclose any exercise limitations that I am aware of or have been informed of by my doctor, so that James Ignatowich Pickleball can develop a modified training plan for my personal considerations. During the program if my condition or physical limitations change, I will notify James Ignatowich Pickleball. 

 

I understand that it is recommended that I have a yearly physical or more frequent physical examinations if needed with my physician so I am aware of what I am capable of or limited to in terms of physical activity. I acknowledge that I have either had a physical exam and have been given my physician’s permission to participate or I have decided to participate without the approval of my physician at my own risk.

 

I understand that while James Ignatowich Pickleball will review any disclosed physical limitations that I may have, James Ignatowich Pickleball is not a physician and cannot replace the advice and expertise of a physician.

 

I understand that I have the right to stop or decrease exercise at any time during a session and that it is my obligation to notify my physician or seek medical attention immediately if I develop any symptoms such as shortness of breath, fatigue, or chest discomfort.

 

I realize that participation in the program including but not limited to exercising, use of equipment, and strenuous exertion (strength training) all of which increase heart rate and body temperature. I understand that exercise involves certain risks that include but are not limited to, serious spinal and neck injuries resulting in complete or partial paralysis, heart attack, stroke, or even death. Injuries could occur to bones, joints, or muscles. Slips, falls, and unintended loss of balance could result in muscular, orthopedic, neurological, or other bodily injury. I understand that part of the risk involved in participating in any activity or exercise training program is relative to my own state of fitness or health (mental, physical, or emotional) and to the awareness, case and skill which I conduct myself in that activity or exercise training program.

 

Knowing the material risks and appreciating, knowing and reasonably anticipating that other injuries are possible, I hereby expressly assume all of the described risks of injury, all other possible risk or injury, and even risk of possible death, which could occur by reason of my participation and do hereby waive, release and forever discharge to James Ignatowich Pickleball (www.jamesignatowich.com) from any and all responsibilities or liability for any present and future injuries or damages resulting or arising from my participation in any activities including but not limited to exercise, personalized virtual coaching/lessons, or use of the equipment including any injuries and damages caused by the negligent act or omission of any of those persons or entities mentioned above.

 

VIRTUAL COACHING/LESSONS/TRAINING POLICIES & PROCEDURES

 

The virtual coaching/lessons/training must be ordered and paid in full prior to having James Ignatowich Pickleball send the online package of coaching notes (PDF) and personalized training plan files to your provided email address.

 

Online training package PDF files may be printed out for personal use, but are not to be distributed to any other individuals other than the purchaser.

 

I declare that I have read, understand, and agree to the contents of this Virtual Coaching/Lessons/Training Agreement in its entirety. I understand that the Assumption of Risk, Waiver of Liability, and Personal Coaching/Training Policies and Procedures are intended to be as broad and inclusive as permitted and agree that if any portion is held invalid, the remainder of the Agreement will continue in full force and effect.
